The protection of your personal data is important to YONTEC and we comply with applicable laws and regulations, including the GDPR.
Below we clarify how we handle your personal data.

1. WHO IS THE PROCESSING CONTROLLER?

YONTEC NV, with registered office at 3500 Hasselt, Kuringersteenweg 304, bus 3, and with company number 0842.796.079, is the controller for processing your personal data.

If you contact us because you want to exercise one of your rights (see point 7), please indicate clearly which right you want to exercise. Please be as specific as possible when exercising your rights.

2. WHAT PERSONAL DATA DO WE PROCESS?

Depending on your capacity, we collect the following personal data:

  •  From customers: general identification data (such as name, title/job title, cell phone and/or phone number, email); financial identification data (such as identification and bank account numbers); financial transactions (such as amounts to be or have been paid, payment receipts, statement of payments); professional activities (including nature of activity and profile sought); contracts and agreements with YONTEC; any other personal data they lawfully provide to YONTEC.
  • From prospects: general identification data (such as name, title/job title, cell phone and/or phone number, email); professional activities (including nature of activity and profile sought); any other personal data they lawfully provide to YONTEC.
  • From suppliers: general identification data (such as name, title/job title, address, cell phone and/or phone number, email); financial identification data (such as identification and bank account numbers); financial transactions (such as amounts to be or have been paid, payment receipts, statement of payments); professional activities (including nature of activity, nature of goods/services provided); contracts and agreements with YONTEC; any other personal data they lawfully provide to YONTEC.
  • From job applicants: all data (e.g. in CV and/or cover letter) that they communicate and lawfully provide to YONTEC.
  • From website visitors: data collected through cookies (cookie policy) or entered by website visitors on the form.
  • From social media users: advertising through data they provide to social media.

If you provide us with personal data from a third party, such as, among others, your employees, independent contractors, customers, or suppliers, you warrant to YONTEC that you (a) lawfully obtained such personal data from the third party and lawfully provided it to YONTEC; (b) provided YONTEC with personal data that is up-to-date; and (c) provided that person with relevant information about the existence and content of this Policy.

3. WHY DO WE PROCESS PERSONAL DATA (PURPOSES)?

Personal data is processed for the following purposes:

3.1. Execution of the agreement and/or arrangements.: proper execution and fulfillment of the agreement and/or appointments; communications related to this agreement and appointments; billing; customer service.

3.2. Direct marketing: sending newsletters. If you no longer wish to receive these communications, you may opt-out via the provided opt-out. You will then no longer receive direct marketing from us about the communications you no longer wish to receive, and we will stop processing your personal data for these direct marketing purposes.

3.3. Applicant Management

3.4. Necessary for the operation of our business: to improve and optimize our services (incl. cookies and social media advertising); to take care of and improve the website (incl. cookies); to retain personal data as evidence or for bringing legal action;

3.5. Meeting legal obligationen (for example, in the context of anti-money laundering and counter-terrorism legislation);

3.6. General: You are not required to share your personal data with us, but if you do not provide the personal data requested, we may not be able to provide you with the services and/or products you require.

4. LEGAL BASIS OF PERSONAL DATA?

The processing of personal data under point 3.1 is based on the performance of the contract or to take measures, at the request of the data subject, before the conclusion of the contract.

The processing of personal data of prospects under section 3.2 and the processing of personal data through cookies other than technical and functional cookies under section 3.4 is based on the consent of the data subject.

The processing of personal data under point 3.2 for B2B customers and initial contact with B2B prospects, as well as the other processing of personal data under points 3.3. and 3.4 is based on the legitimate interest of our company (only and when the legitimate interest of our company outweighs the interest of the data subjects). The interests were further explained under sections 3.2, 3.3. and 3.4.

The processing of personal data under section 3.5 takes place to comply with legal obligations incumbent on our company.

5. WITH WHOM DO WE SHARE PERSONAL DATA?

We only provide relevant aspects of personal data to third parties if these parties are contractually affiliated with YONTEC or act on behalf or subcontracted by YONTEC. Naturally, we have made agreements with these parties regarding the protection of your personal data. In the legally determined cases, we are obliged to communicate certain personal data to the well-defined bodies.

We also do not provide personal data to companies outside the European Economic Area, unless it is subject to an adequacy decision, standard provisions, appropriate safeguards, binding corporate rules or transfers referred to in Article 49(1) GDPR.

In the event of a full or partial reorganization, merger, demerger, acquisition or sale of assets, we are entitled to transfer the personal data to the relevant third party.

6. HOW LONG DO WE KEEP PERSONAL DATA?

We retain personal data only for as long as it is necessary for carrying out the purposes specified above. Since the retention period depends on the purpose as well as the type of personal data, the retention periods vary.

7. WHAT RIGHTS DO YOU HAVE?

7.1. Right of inspection,
You have the right to access your personal data. If you request it, we will provide you with a copy of the personal data processed.

7.2. Right of rectification
You have the right to have inaccurate or incomplete personal data corrected.

7.3. Right of erasure
You have the right to ask YONTEC to delete your data in the cases specified in Article 17(1) GDPR, such as if you withdraw your consent or if you object to processing for direct marketing.

In such a case, YONTEC will delete your data without delay, unless Article 17(3) GDPR applies. Among other things, YONTEC will not have to delete your personal data if this is necessary in the context of complying with a legal obligation.

7.4. Right to restriction of a processing that concerns you
You have the right to have the processing restricted in the cases specified in Article 18(1) GDPR, e.g.: if the accuracy of the personal data is disputed.

7.5. Right to data portability.
You have the right to request the personal data that you yourself have provided to YONTEC or have it transferred to another company.

7.6. Right to withdraw consent
You have the right to withdraw your consent at any time. The withdrawal of your consent does not affect the lawfulness of the processing based on the consent prior to its withdrawal

7.7. Right to file a complaint with supervisory authority.
If you do not agree with YONTEC's position, if you would have comments regarding the exercise of your rights, or if you believe that the processing of your personal data does not comply with the legislation, including the GDPR, you may lodge a complaint to the competent supervisory authority in this regard.

7.8. Right to object to processing.
You always have the right to object to processing for the purpose of direct marketing. Practically, you can do this by the provided "opt-out". Then you will no longer receive direct marketing from us about the communication no longer desired, and we will stop processing your personal data for these direct marketing purposes.

Of course, if necessary, we may still contact you in connection with the execution of the agreement.

In addition, you also always have the right to object to processing based on Article 6(1), (e) or (f) GDPR.

8. COOKIES

YONTEC also uses cookies on the website. Cookies are small pieces of information that are stored by the browser on your computer and allow us to register certain information about the users of the website (e.g. choice of language, duration of your visit to the website, ...).
